Understanding The Charge You Face

Assault and battery charges are not synonymous and have different definitions and consequences.

Assault: Any intentional conduct putting an individual in a position that causes them to reasonably fear physical harm is considered assault. This includes threatening violence toward another person and does not require physical contact. In Illinois, words alone are not counted as assault but you may be charged with assault if your words and conduct together cause someone to reasonably believe they are about to be injured.

Aggravated Assault: Aggravated Assault is when someone knowingly commits an assault on a physically handicapped person or a person who is of 60 years of age or older. Aggravated Assault can either be a Class A misdemeanor in Illinois or it may be sometimes charged as a felony.

Battery: In Illinois, battery is defined as insulting or provoking physical contact or causing bodily harm to another. Battery can consist of anything from pushing to hitting someone, or even grabbing and tearing another person’s clothing.
