If you’ve been arrested for an Aggravated Driving Under the influence (DUI) Offense in Illinois, it is crucial to contact an attorney right away. At Shifrin Law Group in Chicago a large part of our practice focuses on traffic and criminal charges. We have the skill and experience to guide you and protect your rights.

Have You Been Charged With A Felony DUI?

In Illinois, a DUI is typically considered a misdemeanor. However, a DUI can become a felony when certain aggravating factors are involved. Maximum sentences for felony aggravated DUIs can exceed one year in prison. Typically, individuals found guilty of such charges will face at least 1-3 years of incarceration.

A DUI may become an Aggravated DUI, a felony offense, if any one of the following circumstances apply:

  • Driving while your license is revoked or suspended
  • Driving without valid insurance
  • Prior DUI violations
  • Accidents resulting in bodily harm
  • Accidents causing a fatality
  • A second DUI while transporting minors under age 16
  • Driving in a school zone
  • Accidents resulting in bodily harm to a minor

If you are arrested for a DUI in Illinois and one of these circumstances apply, you will be facing more severe consequences. It is important you contact an experienced attorney in order to have the best possible outcome.

Being arrested for a felony DUI can also result in a conviction which will be on your permanent driving and criminal record. In order to help fight a DUI arrest, it is important to call an attorney as soon as possible. Our criminal defense team is experienced in handling DUI cases, criminal defense issues and all types of traffic violations. We can help you fight it.

The DUI Court Proceedings

During your first court appearance, your attorney will request a copy of all discovery materials from your DUI arrest. This includes the police report, your alcohol and drug influence report, the warning to motorist, a copy of your ticket and footage from your arrest. All Chicago police officers are required by law to wear body worn cameras during interactions with suspects, and all Illinois State Police vehicles are required to have squad car cameras.

Additionally, your attorney may also submit a petition to the court requesting that the defendant’s driver’s license suspension be rescinded. This is called a Petition to Rescind the Statutory Summary Suspension.

An attorney only has 90 days to file this petition, so it is crucial you contact an attorney immediately after your DUI arrest. When this petition is filed, the court must hear the matter within 30 days of filing. If the court grants your petition, you will still be able to drive while you fight your DUI charge.

Being accused of driving under the influence (DUI) can be an incredibly stressful experience. You may be at risk of losing your license, paying large fines, harming your relationships and your career or even spending time in jail. We know the law, we know the local courts, and we know how to help our clients reach favorable outcomes.
