How The Law Defines A Theft Crime

In Illinois, theft is generally defined as knowingly taking control over another’s property without authorization and with the intent of permanently depriving the owner of their property.

“Property” includes:

  • Money
  • Real property
  • Personal property
  • Animals
  • Financial instruments
  • Computer programs
  • Tickets
  • Services
  • Store or retail items
  • Other items

There are many types of crimes involving theft or larceny including embezzlement, theft by deception, extortion and receiving stolen property. While the general theft statute in Illinois covers the majority of theft-related crimes, there are also some laws about specific types of theft, including identity theft, theft of utility and communication services, theft of lost or mislaid property, theft of temporary use of property, labor or services for hire and financial exploitation of an elderly or disabled adult.

There Is No Minimum Value

In Illinois, stolen property does not need to have a minimum value in order to be a crime, but the value of the stolen items will determine the penalties. Depending on the details of the case, theft in Illinois can result in various misdemeanor or felony charges, massive fines and prison sentences ranging from less than a year to 30 years depending on the seriousness of the theft.
